Privacy Policy

1. Introduction

Who we are. Goonwall is operated by Towlen LLC, of 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. Towlen LLC is the controller of your personal information: it decides how and why that information is used. You can contact us about your information at privacy@goonwall.com.

Welcome to Goonwall ("we," "our," or "us"). We are committed to protecting your privacy and personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website and use our services.

2. Information We Collect

We may collect information about you in various ways, including:

  • Personal Data: Email address, username, and account preferences when you register
  • Usage Data: Information about how you interact with our website
  • Device Data: Browser type, IP address, and device identifiers
  • Cookies: Small data files stored on your device for functionality and analytics

If you buy a Pass, we also record what you bought, the amount, the date, the country you tell us you are buying from, and the country your connection comes from. We look that up from your IP address at checkout, and we don't keep the address. We are required to keep a record of where each sale took place, and a cryptocurrency payment does not tell us — which is why we ask you at checkout. It does not affect the price, which is the same everywhere.

If you ask for a refund, we record the cryptocurrency address you give us to send it to, and the transaction reference once it has been sent.

We never receive or store card details, bank details or any other payment credential.

If you ask us to tell you when the Pass goes on sale, we keep a note of that request.

Whether you're online. While you're signed in and have Goonwall open, your browser tells us you're there about once a minute.

If something you post or send is held for a child-safety review, we keep the IP address it came from with it, for that review and for any report the law requires.

Messages. If you use private messaging, we store the messages you send and receive and information about them: who sent each message, who received it, and when.

If you join through a partner's referral link, we note which partner's link you used. Partners see only totals, never who signed up or bought.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our services
  • Process transactions and send related information
  • Send you technical notices and support messages
  • Respond to your comments, questions, and requests
  • Monitor and analyze trends, usage, and activities
  • Detect, investigate, and prevent fraudulent transactions
  • Keep the records of sales and refunds that tax law requires us to keep
  • Show your friends which of their friends are online
  • Check what's posted on Goonwall against our rules, automatically when it's posted, and investigate reports. These checks run on Goonwall's own systems.
  • Deliver messages between you and the people you message, and the chat in watch parties
  • Check messages automatically for content that breaks our rules, such as links, payment details and signs of the sexual exploitation of a child, so that it can be held or reviewed by a person. Your messages are never sent to anyone else to be checked, and are never used to train any system.

The purchase information described above is used for our records and to meet our tax obligations. It is not used for advertising, profiling or building a picture of you, and it is shared only with the services that process payments for us, described below, and where we are required to disclose it.

We take payments in cryptocurrency through PayRam, payment software we run on our own server. The payment page may be served through PayRam's service, which sees the payment itself and the wallet address you pay from, but not your Goonwall email address or username. Payments on a blockchain are public by nature: anyone can see a transfer between two wallet addresses, though not who owns them.

4. Sharing Your Information

We do not sell, trade, or rent your personal information to third parties. We may share your information only in the following situations: with your consent, for legal compliance, to protect our rights, or with service providers who assist in our operations.

As US law requires, we report content involving the sexual exploitation of a child to the National Center for Missing & Exploited Children.

Messages are never shared with other members except the person you are messaging. We disclose messages to law enforcement only where the law requires it, in response to a valid legal request, or where someone's safety is at immediate risk, and we disclose only what is necessary.

Everyone in a watch party can read its chat, including people who are only watching. When the party ends, the chat is hidden from everyone.

Whether you're online is shown only to your friends: as part of a number on the hub, and next to your username wherever they see their friends, such as their Friends page. We never show when you were last online. You can turn this off in Settings with “Let friends see when I'm online”. While it's off, we don't record that you're online at all, so you don't appear in the number or by username.

5. Data Security and How Long We Keep Things

We implement appropriate technical and organizational security measures to protect your personal information. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

We keep your account information for as long as your account exists. If you close your account, you have 30 days to change your mind: sign in and you can restore it. After 30 days, we delete it.

Records of purchases and refunds are one exception. Tax law requires us to keep them, and we cannot delete them on request — including after you close your account. We keep them for as long as we are required to, which can be up to ten years, and then delete them. The other exception is anything we must keep for an investigation or by law, for example content held for a child-safety review, and the IP address we keep with it. If we report it, we keep it for at least a year after the report. A deletion request does not reach these while we have to keep them.

Whether you're online is kept for about two minutes, then discarded. We keep no history of it.

A request to hear when the Pass goes on sale is deleted once we've emailed you.

If the review clears it, we delete that IP address and our copy of the held content within 30 days. If we have to report it, we keep them for at least a year, as US law requires.

Messages are kept while either person in the conversation keeps it. When you delete a message, it disappears straight away and shows as “Message deleted”. We remove its words from our systems within 30 days, and keep them until then only so that a report made in that time can still be looked into. When both of you have deleted a conversation, all of it is removed from our systems within 30 days. When your account is deleted, 30 days after you close it, the words of every message you sent are removed, and the other person sees them as deleted. A reported message is kept for up to one year for our investigation, or longer where the law requires it.

A watch party's chat is deleted 30 days after the party ends, unless we must keep part of it for an investigation or by law.

6. Your Rights

Depending on your location, you may have the following rights:

  • Access and receive a copy of your personal data
  • Rectify or update inaccurate personal data
  • Request deletion of your personal data
  • Object to or restrict processing of your data
  • Data portability
  • Withdraw consent at any time

There are two limits on deletion, both described in section 5: the purchase and refund records we're required to keep, and anything we must keep for an investigation or by law. Everything else goes.

A conversation belongs to two people. If you ask for a copy of your data, it includes the messages you sent and received. If you ask us to delete your data, we delete the messages you sent; the other person keeps their own messages, and yours show to them as deleted. We cannot delete a message we are required to keep for an investigation or by law.

7. Cookies

We use cookies and similar tracking technologies to track activity on our website and store certain information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.

8. Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of these sites. We encourage you to read the privacy policies of any third-party sites you visit.

9. Children's Privacy

Our services are intended for users who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we discover we have collected information from a minor, we will delete it immediately.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date.
