1. Acceptance of Terms
Goonwall is operated by Towlen LLC, a New Mexico limited liability company, of 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States ("we", "us"). These Terms are an agreement between you and Towlen LLC.
By accessing and using Goonwall ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service.
2. Age Requirement
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access or use this Service. By using this Service, you represent and warrant that you meet this age requirement.
3. User Accounts
When you create an account with us, you must:
- Provide accurate, complete, and current information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. User Content
You retain ownership of content you upload. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform.
You warrant that you own or have the necessary licenses, rights, consents and permissions to upload the content and to grant us the license above. This includes the consent of every person depicted, and the rights in any music or third-party material the content contains. If you cannot give that warranty for a piece of content, do not upload it.
You agree not to upload content that:
- Violates any applicable laws or regulations
- Infringes on intellectual property rights
- Contains malicious code or viruses
- Depicts minors in any way
- Is non-consensual or involves exploitation
5. Prohibited Activities
You agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use automated means to access the Service without permission
- Redistribute or resell our content without authorization
5A. Private messages
5A.1 Who you can message. You can send private messages to members who have accepted your friend request. Either of you can block the other at any time, which ends the conversation for both of you.
5A.2 What you must not do in messages. These rules cover everything you send in a message: text, GIFs, stickers and links. In messages you must not:
- mention, describe, request or share anything sexual involving anyone under 18, or anyone who appears to be under 18;
- describe or encourage sexual activity without consent, or pressure or coerce anyone;
- offer, request or arrange sex, sexual services or in-person meetings in exchange for money or anything of value, or advertise escort or similar services;
- harass, threaten, intimidate or abuse anyone, or keep messaging someone who has asked you to stop;
- share anyone's personal information — their real name, address, workplace, photographs or contact details — without their permission;
- ask for, offer or arrange a payment of any kind, share payment links, payment handles or cryptocurrency addresses, or sell goods or services;
- share contact details for yourself or anyone else — phone numbers, email addresses, or usernames on other apps or websites — or ask someone to continue the conversation somewhere else;
- send spam, scams or phishing, or pretend to be someone else, including Goonwall staff.
5A.3 Links. You can share links to pages on Goonwall and to Goonwall's official Discord server. Links to other websites are not allowed in messages.
5A.4 Reports and what we do. You can report any message. When a message is reported, we review that message and the messages immediately around it, and nothing else in the conversation — unless the report concerns the safety of a child, or the law requires it, in which case we may review more of the conversation to understand what happened. We may remove messages, restrict your messaging, or suspend or close your account. We report content involving the sexual exploitation of a child to the National Center for Missing & Exploited Children and to the police, and we share information with law enforcement where the law requires it or someone's safety is at risk.
5A.5 Privacy and automated checks. Your messages are private between you and the person you are messaging. Goonwall staff do not read them except as described in 5A.4 or where the law requires. We use automated checks to look for messages that break these rules — for example links, payment details, and signs of the sexual exploitation of a child — and a check may hold a message or flag it for review by a person. Automated checks decide whether a message is shown; decisions about your account are made by a person.
5A.6 Deleting messages. You can delete messages you have sent. This applies to direct messages. In watch-party chat you can't delete a message yourself: party chat is hidden when the party ends and deleted 30 days later. A message that has been reported is kept for our investigation, and for as long as the law requires, even if you delete it.
5A.7 Watch-party chat. The rules in this section also apply to the chat in watch parties. Everyone in a party can read its chat, including people who are only watching.
5B. What you write in public
5B.1 This section covers what you write where other members can see it: a channel's name and description, comments and replies, and anything else public you can write on Goonwall. It covers everything you post there: text, GIFs, stickers and links.
5B.2 In public, you must not:
- share links to other websites. You can link to pages on Goonwall and to Goonwall's official Discord server;
- share contact details for yourself or anyone else (phone numbers, email addresses, or usernames on other apps or websites), or invite people to contact you somewhere else;
- ask for, offer or arrange a payment outside Goonwall, share payment links, payment handles or cryptocurrency addresses, or advertise anything for sale outside Goonwall.
- use words that suggest anyone involved is under 18, even in role-play.
5B.3 We check what you write in public automatically when you post it. If it breaks 5B.2, we'll tell you why, and you can change it. We may also remove or hide anything you post that breaks any other part of these Terms.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Goonwall and are protected by international copyright, trademark, and other intellectual property laws.
7. Purchases and Billing
7.1 The Pass. Goonwall offers a paid membership, the Pass, which unlocks additional features. All content on Goonwall remains free to view with an account; the Pass unlocks features only. The Pass is a one-off purchase of a fixed period of access, available in two lengths: $60 for a year, or $20 for three months. It does not renew and nothing is charged automatically. We store no payment method. When the period you bought ends, the Pass ends; buying more time adds it to any time you have left. Prices are shown at checkout in US dollars and include all applicable processing fees.
7.2 Payment processing. The Pass is paid for in cryptocurrency. We do not receive or store card details, bank details or any other payment credential, and we create no stored mandate of any kind. Payment reaches us directly; where you use a third-party service to obtain cryptocurrency first, that service is your own counterparty and your dealings with it are subject to its terms, not ours. A cryptocurrency payment cannot be reversed or charged back once made — see our Refund Policy, which is the route to getting your money back.
7.3 Immediate access. The Pass is digital content supplied immediately on purchase. At checkout you will be asked to confirm that you want immediate access and that you understand this ends your 14-day right to cancel. See our Refund Policy.
7.4 No automatic renewal. The Pass does not renew. Nothing is charged automatically, no recurring mandate is created, and no payment method is stored to charge you with. When the period you bought ends, your Pass ends and your account returns to the free tier.
7.5 Nothing to cancel. Because there is no recurring charge, there is no subscription to cancel and no action you need to take to stop one. You keep access for every day of the period you bought. We show the end date on your account page throughout and remind you before it arrives. Buying further time adds to any days you have left rather than replacing them. Letting a Pass lapse and deleting an account are separate acts: neither requires the other.
7.5a Duration. The Pass grants access for the period you purchased and for as long as Goonwall operates the service. It is not a guarantee that the service will operate indefinitely, and it does not entitle you to any specific feature remaining available.
7.6 Feature changes. Which features the Pass unlocks may change as the service develops. We will not materially reduce what the Pass provides without notice.
7.7 Refunds. Set out in our Refund Policy.
7.8 Suspension. If your account is suspended or terminated for breach of these Terms, any remaining Pass access ends and is not refunded, except where the law requires otherwise.
7.9 Taxes. The price shown at checkout is the total you pay. Where any sales tax or VAT applies to your purchase, it is included in that price — nothing is added on top. The price is the same in every country. At checkout we ask which country you are buying from, because a cryptocurrency payment does not tell us and we are required to record where each sale took place; see our Privacy Policy.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
9. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Service's operation, accuracy, or availability.
10. Limitation of Liability
In no event shall Goonwall, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
11. Indemnification
You agree to defend, indemnify, and hold harmless Goonwall and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
